BGV firms often act as Data Processors for the employer. However, if the firm decides which databases to check or stores data for its own 'master database,' it may be classified as a Data Fiduciary.
Can we store candidate data to speed up future checks for other clients?
No. DPDP requires purpose limitation. Data collected for one employer's check cannot be reused for a different client without fresh, explicit consent from the candidate.
Do we need consent to check publicly available court records?
