DPDP Action Sheet

Use this before your next workflow goes live. It keeps the useful parts visible and turns DPDP into checks your team can actually answer.

For DPDP Compliance for Driving Schools, the DPDP question is how personal data enters the workflow, where it is stored, which tools touch it, what purpose was explained, and how deletion or withdrawal will work.

1. Lead Forms

Check:

  • What data are you collecting?
  • Is the purpose clear at the point of collection?
  • Is marketing consent separate from service communication?
  • Can the user withdraw consent later?

Common mistake: one checkbox that silently covers newsletters, sales calls, partner sharing and remarketing.

2. Email and WhatsApp

Check:

  • Who is on the list?
  • Where did consent come from?
  • Is the list imported from a vendor, event, webinar, scrape or old CRM?
  • Can you prove the source of consent?

Common mistake: treating every lead as permanently marketable.

3. Ads and Retargeting

Check:

  • Are pixels or ad platforms receiving identifiable user behavior?
  • Are audiences built from customer lists?
  • Are lookalike or remarketing audiences using personal data?

Common mistake: assuming "the ad platform handles it" means your company has no DPDP responsibility.

4. Website Analytics

Check:

  • Which tools run on the site?
  • Are IP address, device identifiers, session IDs or form fields being captured?
  • Is analytics used only for measurement, or also for profiling and targeting?

Common mistake: installing tools first and asking privacy questions later.

5. Vendor List

Make a quick list:

  • CRM
  • Email platform
  • WhatsApp provider
  • Analytics
  • Ad pixels
  • Form tool
  • Landing page builder
  • Webinar tool

For each vendor, answer: what data goes there, why, who can access it and how deletion works.

6. This Week's Action

Map one campaign from first click to final follow-up. Mark every place personal data is collected, enriched, shared, uploaded or used for targeting.

If your team cannot answer where the data came from and where it goes next, start with a data flow map before rewriting policy copy.

Handling Identity and Minor Data

Driving schools in India function as intermediaries between citizens and Regional Transport Offices (RTOs). You collect highly sensitive data including Aadhaar numbers, PAN cards, and birth certificates to facilitate the Sarathi portal applications. Because many learners are between 16 and 18 years old, you are often processing “children’s data” under DPDP. This requires parental consent and strictly prohibits any tracking or behavioral monitoring of these students.

The Retention Conflict

A major conflict for driving schools is the habit of keeping “student files” indefinitely. Many schools keep photocopies of Aadhaar cards and old learner licenses for years in case of RTO disputes or for marketing license renewals. DPDP requires you to delete personal data the moment the specific purpose (getting the license) is finished. Keeping identity documents “just in case” is a direct violation. You must establish a clear timeline to shred physical documents once the RTO processes the application.

This week

Review your physical filing cabinet and digital folders to identify every student who received their permanent license more than 90 days ago. Securely shred their physical ID photocopies and permanently delete their Aadhaar scans from your computer or WhatsApp history.

Frequently asked questions

Can I keep photocopies of student Aadhaar cards after they receive their license?

No. Once the RTO verifies the identity and issues the license, the purpose of holding the Aadhaar copy is fulfilled. You must delete digital scans and shred physical copies unless a specific law requires longer retention.

What special rules apply if I teach students under age 18?

For learners aged 16 to 18 applying for non-gear licenses, you must get verifiable consent from a parent or lawful guardian. You cannot track their behavior or target them with advertising that could cause harm.

Do I need a separate consent form to upload data to the Sarathi portal?

Yes. Your enrollment form must explicitly state that you will share the student's personal data and ID proofs with the Ministry of Road Transport and Highways (MoRTH) for license processing.
